End User License Agreement

This End User License Agreement (“EULA”) is a legal agreement between you and ReaLife Sparks LLC for the ReaLife application (“App”) on iOS, Android, and website. By downloading, installing or using the App, you agree to this EULA. It supplements our Terms of Service and Privacy Policy. If you obtained the App through the Apple App Store or Google Play, the store terms below also apply.

1. License grant

ReaLife Sparks LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, solely for your personal, non-commercial use, in accordance with this EULA and the applicable app store’s usage rules. You must be at least 18 years old to use the App.

2. Restrictions

You may not:

  • Copy, modify, or create derivative works of the App.
  • Reverse engineer, decompile, or disassemble the App, except where permitted by law.
  • Rent, lease, lend, sell, sublicense, or otherwise distribute the App.
  • Remove or alter any proprietary notices.
  • Use the App in any unlawful manner or in violation of our Terms of Service.

3. User content and zero tolerance for objectionable content

The App lets you create and join Sparks, share photos, and message other members, so you agree that there is no tolerance for objectionable content or abusive behaviour. This includes content that is unlawful, harassing, hateful, sexually explicit involving minors, violent, or otherwise objectionable. By using the App you agree to:

  • Not post objectionable content or engage in abusive behaviour toward other members.
  • Use the in-app tools to report objectionable content and block abusive users.
  • Understand that we may remove content and remove or eject members who violate these terms.

We act on reports of objectionable content by removing the content and taking action against the responsible account, typically within 24 hours of a report.

4. Meeting people in person

Sparks lead to real world meetups that we do not supervise. Meet in public places, tell someone where you are going, and leave whenever you want. Verification is our primary trust signal and is not a background check. See our Safety page.

5. Ownership

The App is licensed, not sold. ReaLife Sparks LLC and its licensors retain all right, title and interest in and to the App, including all intellectual property rights.

6. Updates

We may provide updates, upgrades or patches for the App. This EULA governs any such updates unless they are accompanied by separate terms.

7. Optional purchases

Creating and joining Sparks is free. Any optional paid feature or subscription is sold through the Apple App Store or Google Play Billing, shows its price and duration before purchase, renews automatically until canceled in your store account settings, and is refundable only under the applicable store rules and law. Full details are in section 7 of our Terms of Service.

8. Apple App Store additional terms

If you obtained the App from the Apple App Store, the following applies. This EULA is between you and ReaLife Sparks LLC only, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

9. Google Play additional terms

If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service, and this EULA does not limit any rights you have under those terms.

10. Disclaimers and limitation of liability

The App is provided “as is” without warranties of any kind. To the maximum extent permitted by law, ReaLife Sparks LLC will not be liable for any indirect, incidental or consequential damages arising from your use of the App. These limitations are part of the basis of the agreement between you and us.

11. Termination

This EULA is effective until terminated. Your rights under it end automatically if you fail to comply with any of its terms. Upon termination, you must stop using the App and delete all copies. You can delete your account at any time through our Account & Data Deletion Policy.

12. Governing law

This EULA is governed by the laws of the State of Georgia, without regard to conflict of laws principles, except where the applicable app store requires otherwise. Disputes are resolved in the state and federal courts located in Fulton County, Georgia.
